As A Grandparent, You Do Have Rights

Ohio grants limited rights to grandparents. However, in certain circumstances, grandparents can petition the court to obtain visitation or custody of their grandchildren.

When parents are deceased or determined “unfit,” grandparents may be able to obtain custody of their grandchildren. In other circumstances, grandparents can petition the court for visitation rights. The standard used by courts when making custody and visitation decisions is “the best interests of the children.” Factors evaluated when making this determination include:

  • Whether grandparents and grandchildren have an established relationship
  • Whether emotional harm will result to grandchildren if denied time with their grandparents
  • Whether the grandchild wishes to have a relationship with his or her grandparent
  • The geographical distance between the parents and grandparents
  • Whether grandparents are currently the primary caretaker of the grandchild
  • The health and safety of the grandchild
